This Privacy Policy (hereinafter the PRIVACY POLICY) regulates, in general, the collection and processing by BASQUE CULINARY CENTER FUNDAZIOA (hereinafter the BCC) of the personal data you provide as a User of the website accessible through the domain name https://www.bculinary.com/es (hereinafter the WEBSITE), including the blog, social media, newsletter and information services and any other functionality that may be available through the WEBSITE at any time. All of this is without prejudice to the specific provisions that may apply to certain sections, forms or services available on the WEBSITE in order to provide you with the relevant information and, where applicable, to obtain your consent. The BCC reserves the right to modify the PRIVACY POLICY to adapt it to legislative, jurisprudential and/or administrative changes and to the practices it engages in at any time through the WEBSITE, at all times taking into account its rights and interests. In all cases, the BCC will provide you with the appropriate technical resources for you to access the PRIVACY POLICY in order to comply with the duty of information that we are required to observe according to the applicable data protection law.

The Data Controller of your data is the BASQUE CULINARY CENTER HEZKUNTZA FUNDAZIOA, whose registered office is Donostia-San Sebastián (Guipúzcoa), Paseo Juan Avelino Barriola, no. 101, registered in the Foundations Register of the Basque Country under registration number F-253, and holding fiscal identification number (CIF) G-20998100. For any matters relating to the PRIVACY POLICY and/or the processing of your personal data, you may contact us at the abovementioned postal address and/or the email address lopd@bculinary.com. 



 

  • How do we obtain your data? 


 

The data processed by the BCC are obtained from you, the User, through (i) the different forms that you fill out while browsing the WEBSITE (e.g. registration form as a user of the WEBSITE, contact forms, information request forms, forms relating to job offers and/or selection processes, etc.); or (ii) by sending an email with an enquiry. If the personal data provided belong to a third party, you will need to guarantee that you have informed said third party about the PRIVACY POLICY and have obtained their authorization to send their data to the BCC for the purposes indicated below. In addition, you are informed of the possible processing of your social media data through the corporate profiles that the BCC keeps available on each social network in which it has a presence, all according to the terms and conditions established by each social network. The provision of the data collected in the forms available on the WEBSITE is mandatory when they are identified by an asterisk (*) and failure to provide this information will make it impossible to manage your request, whether it concerns your registration as a User, a request for information, a subscription to our newsletter service or any other service featured on the WEBSITE. 



 

  • What type of data do we process? 


 

The data processed by the BCC are those that you have provided by means of the relevant forms that we use to formalize our contract with you and/or information sent by email, as well as other information that, where applicable, we obtain from the corporate profiles of the BCC on the social networks on which we have a presence.

Your personal data is processed for the following purposes:

  • To manage and process your registration as a User, when this is possible.
  • To manage the access and use of the content and services that the BCC makes available on its WEBSITE, including the blog, social media or any other functionality that may be accessible on the WEBSITE at any time.
  • To manage and process requests for information, suggestions, complaints or claims made through the WEBSITE or by email.
  • To send Users by different means, including electronically, commercial correspondence and advertising of the BCC and/or the BASQUE CULINARY CENTER HEZKUNTZA FUNDAZIOA in relation to the products, services, offers, promotions and any other relevant information concerning these entities and the activities they engage in in the fields of training and gastronomy, provided that you have given your consent.
  • To manage your job application or registration for job offers and your participation in the corresponding selection processes.
  • The processing of your personal data by the BCC, in accordance with the applicable law, is based on the consent given at the time your personal data are collected, which you provide voluntarily by means of the mechanisms established for this purpose on the WEBSITE.

You are reminded that you may, at any time, revoke your consent freely and free of charge in accordance with the terms indicated in Section 7 below. 

  1. Who do we share your personal data with? 

You are informed that your personal data may be shared with the following third parties:

  • Public bodies and administrations to which the BCC has a legal obligation to communicate its data.
  • Provided you have given your consent, to the associated entity of the BASQUE CULINARY CENTER HEZKUNTZA FUNDAZIOA and/or other entities associated with the BCC and/or the BASQUE CULINARY CENTER HEZKUNTZA FUNDAZIOA, in order to deal with your requests and enquiries, to send you commercial correspondence on those entities and their respective activities or products, and/or to manage your participation in selection processes conducted by those entities.

We do not envisage making any international transfers of your data. 

 

  1. How long do we keep your data? 

As a general rule, your personal data will be kept until such time as you revoke your consent or ask for them to be deleted, as well as for the time necessary to comply with the legal obligations that the BCC is required to observe. In all cases, you are informed that the BCC has established internal data cleansing policies which are intended to control the storage periods of the personal data under its control, so these data may be cancelled when they are no longer necessary and/or appropriate for the purpose for which they were collected. 

  1. What are your rights? 

The applicable data protection law grants you a series of rights related to your personal data which you can exercise while they are being processed. These rights are detailed below:

  • Access to your data: you have the right to access your data to know what personal information about you we are processing.
  • Request rectification or deletion of your data: in certain circumstances you have the right to rectify inaccurate personal data that concern you which are subject to processing by us, or even ask us to delete data when, amongst other reasons, the data are no longer necessary for the purposes for which they were collected.
  • Request the limitation of the processing of your data: in certain circumstances you have the right to request the limitation of the processing of your data, in which case you are informed that we only keep your data to deal with or defend any claims or complaints as envisaged by the applicable data protection law.
  • Request the portability of your data: in certain circumstances you have the right to receive the personal data that concerns you, and which has been made available to us, in a structured format for common use and mechanical reading, and to transmit them to another data controller.
  • Oppose the processing of your data: in certain circumstances, and for reasons related to your particular situation, you have the right to object to the processing of your data, in which case we will stop processing them unless, for compelling legal reasons or to deal with or defend any potential claims or complaints, they need to be preserved.

You also have the right to withdraw your consent at any time, without this affecting the legality of the processing based on your consent prior to its withdrawal. You may exercise these rights by writing to the BCC at the postal address given in Section 1 or by sending an email to lopd@bculinary.com. Finally, you are informed that you are entitled to lodge a complaint with the competent Data Control Authority (in Spain, the Spanish Data Protection Agency), especially when you have not obtained a satisfactory response in exercising your rights. The BCC will process your data at all times in the strictest confidence, adhering to the mandatory duty of secrecy, in accordance with the provisions of the applicable data protection law, adopting for this purpose the necessary technical and organizational measures to guarantee the security of your data and avoid its alteration, loss, treatment or unauthorized access, taking into account the state of the technology, the nature of the stored data, and the risks to which they are exposed.

  1. ¿Cómo hemos obtenido sus datos?

 

Los datos que tratamos en BCC han sido obtenidos de usted mismo, a través de (i) los distintos formularios que cumplimente durante la navegación a través del WEBSITE (e.g. formulario de registro como usuario del WEBSITE, formularios de contacto, formularios de solicitud de información, formularios referentes a ofertas de empleo y/o procesos de selección, etc.); o (ii) mediante la remisión de un correo electrónico de consulta.

 

En el caso de que los datos personales aportados pertenecieran a un tercero, usted garantiza que ha informado a dicho tercero de la POLÍTICA DE PRIVACIDAD y ha obtenido su autorización para facilitar sus datos a BCC con las finalidades que se señalan más adelante.

 

 

Adicionalmente le informamos del posible tratamiento de sus datos de redes sociales a través de los perfiles corporativos que BCC mantiene disponible en cada red social en la que se encuentra presente, todo ello en los términos y condiciones establecidos en cada red social.

 

La aportación de los datos recabados en los formularios disponibles en el WEBSITE tiene carácter obligatorio cuando así se identifiquen mediante la inclusión de un asterisco (*) y su falta de aportación imposibilitará gestionar su solicitud, ya se refiera ésta a su registro como usuario, la obtención de información, la suscripción al servicio “Newsletter” o a cualquier otro servicio disponible en el WEBSITE.

El tratamiento de sus datos personales persigue las siguientes finalidades:

 

  • Gestionar y tramitar su registro como usuario, cuando éste sea posible.
  • Gestionar el acceso y utilización por su parte de los contenidos y servicios que BCC pone a su disposición a través del WEBSITE, incluidos los servicios de blog, redes sociales o cualesquiera otras funcionalidades que en cada momento resulten accesibles desde el WEBSITE.

Le recordamos que, en cualquier momento, puede revocar su consentimiento libremente y de forma gratuita, en los términos que se indican en el Apartado 7siguiente.

 

  1. ¿A quién comunicamos sus datos?

No está previsto que se realicen transferencias internacionales de sus Datos.

 

  1. ¿Por cuánto tiempo conservaremos sus datos?

 

Con carácter general, los datos personales serán conservados en tanto usted no revoque su consentimiento al tratamiento o solicite su supresión, así como el tiempo necesario para cumplir las obligaciones legales que BCC debe observar.

 

En todo caso, le informamos de que BCC tiene establecidas políticas internas de depuración de datos destinadas a controlar los plazos de conservación de los datos personales que obren en su poder, por lo que éstos podrán ser cancelados cuando dejen de ser necesarios y/o adecuados para la finalidad para la que hubieran sido recabados.

 

  1. ¿Cuáles son sus derechos?

 

La normativa aplicable en materia de protección de datos le otorga una serie de derechos relativos a sus datos personales que usted podrá ejercitar durante el tratamiento de los mismos. Dichos derechos son los que se le indican a continuación:

 

  • Acceso a sus datos: tiene derecho a acceder a sus datos para conocer qué datos personales que le conciernen estamos tratando.
  • Solicitar la rectificación o supresión de sus datos: en determinadas circunstancias, tiene derecho a rectificar aquellos datos personales inexactos que le conciernen que sean objeto de tratamiento por nuestra parte o, incluso, a solicitarnos su supresión cuando, entre otros motivos, los datos ya no fueran necesarios para los fines que fueron recogidos.
  • Solicitar la limitación del tratamiento de sus datos: en determinadas circunstancias, tiene derecho a solicitarnos la limitación del tratamiento de sus datos, en cuyo caso le informamos que únicamente los conservaremos para el ejercicio o defensa de reclamaciones tal y como prevé la normativa aplicable en materia de protección de datos.
  • A la portabilidad de sus datos: en determinadas circunstancias, tiene derecho a recibir los datos personales que le incumban, y que nos haya facilitado, en un formato estructurado, de uso común y lectura mecánica, y a transmitirlos a otro responsable del tratamiento.

 

  • Oponerse al tratamiento de sus datos: en determinadas circunstancias y por motivos relacionados con su situación particular, tiene derecho a oponerse al tratamiento de sus datos en cuyo caso, dejaríamos de tratarlos salvo que, por motivos legítimos imperiosos, o el ejercicio o la defensa de posibles reclamaciones, éstos deban ser conservados.

 

Asimismo, tiene derecho a retirar el consentimiento en cualquier momento, sin que ello afecte a la licitud del tratamiento basado en el consentimiento previo a su retirada.

Finalmente indicarle que puede interponer una reclamación ante la Autoridad de Control competente (en España, la Agencia Española de Protección de Datos), especialmente cuando no haya obtenido satisfacción en el ejercicio de sus derechos. BCC tratará sus datos en todo momento de forma absolutamente confidencial y guardando el preceptivo deber de secreto respecto de los mismos, de conformidad con lo previsto en la normativa de aplicación en materia de protección de datos, adoptando al efecto las medidas de índole técnica y organizativas necesarias que garanticen la seguridad de sus datos y eviten su alteración, pérdida, tratamiento o acceso no autorizado, habida cuenta del estado de la tecnología, la naturaleza de los datos almacenados y los riesgos a que están expuestos.
